Layers. Not one halo

U.S. crypto licensing is not one stamp. In the usual classroom map you hear four layers, and they do not replace each other: (1) FinCEN’s money-services-business story under the Bank Secrecy Act, (2) state money-transmitter licenses in the states that require them for the activity, (3) New York’s BitLicense if the activity is in that story, and (4) SEC and CFTC arguments about whether the activity is a security, a commodity, or something else.

U.S. crypto licensing is not one stamp. In the usual classroom map you hear four layers, and they do not replace each other: (1) FinCEN’s money-services-business story under the Bank Secrecy Act, (2) state money-transmitter licenses in the states that require them for the activity, (3) New York’s BitLicense if the activity is in that story, and (4) SEC and CFTC arguments about whether the activity is a security, a commodity, or something else.

A shop can have an MSB and still owe a state file. A shop can have a state file and still be in an SEC case. A white paper is not a license. A “we’re FinCEN registered” footer is one layer, if it is even true — type it on FinCEN’s own MSB list. Nominative: those marks stay with Treasury.

This classroom is not an MSB, not a money transmitter, not a BitLicensee, not an exchange, not a CASP. Paper bitcoin here cannot be withdrawn. We will not hop KYC. We will not tell you which layer you can skip because a thread said Wyoming was quiet.
